Terms of Service
The terms governing your use of IT Trust VPS services.

1. Introduction
These Terms of Service ("Terms") constitute a binding agreement between ITT Technology (Pty) Ltd trading as IT Trust ("IT Trust", "we", "us") and you ("Client", "you") governing your use of the IT Trust VPS platform available at shop.ittrust.co.za. By placing an order or using our services, you confirm that you have read, understood, and agree to these Terms. If you do not agree, do not use our services.
2. Services
IT Trust provides virtual private server (VPS) hosting services. Upon successful payment, a virtual machine is automatically provisioned on our Proxmox-based infrastructure located in Johannesburg, South Africa. Server credentials and access details are delivered via email once provisioning is complete, typically within 10–15 minutes of payment confirmation.
The specifications (CPU, RAM, storage, and operating system) are as selected at the time of order. Upgrades or downgrades to existing VMs are not currently available through the self-service portal and must be requested via sales@ittrust.co.za.
3. Account Registration
You must create an account to place an order. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at sales@ittrust.co.za if you suspect unauthorised access to your account.
You warrant that all information provided during registration and ordering is accurate, current, and complete. Accounts found to contain false information may be suspended without notice.
4. Payment and Billing
All payments are processed by PayFast (Pty) Ltd, a registered South African payment service provider. By completing a purchase, you authorise IT Trust and PayFast to charge your selected payment method on a recurring monthly basis on the same day of the month your subscription commenced.
All prices are quoted in South African Rand (ZAR) and are inclusive of VAT where applicable. IT Trust reserves the right to adjust pricing with 30 days' written notice. Continued use of the service after a price change constitutes acceptance of the new pricing.
If a recurring payment fails, your service will be suspended and you will receive a notification email. Services remain suspended until outstanding amounts are settled. IT Trust reserves the right to permanently terminate and delete VMs that have been suspended for more than 14 days due to non-payment.
5. Cancellation Policy
You may cancel your subscription at any time by contacting us at sales@ittrust.co.za. Cancellations take effect at the end of the current billing period. No partial-month refunds are issued.
Upon cancellation, your VM and all data stored on it will be permanently deleted at the end of the billing period. It is your responsibility to back up any data you wish to retain before cancellation.
6. Refund Policy
Due to the automated nature of VM provisioning, refunds are not available once a VM has been successfully provisioned and credentials have been delivered. If provisioning fails and no VM is delivered, a full refund will be issued within 5–10 business days.
Refund requests for exceptional circumstances may be submitted to sales@ittrust.co.zaand will be reviewed at IT Trust's sole discretion.
7. Client Responsibilities
You are solely responsible for:
- All content, applications, and data hosted on your VM
- Securing your VM, including OS updates, firewall configuration, and access control
- Compliance with all applicable laws in your jurisdiction and South African law
- Complying with our Acceptable Use Policy
- Maintaining adequate backups of your data
IT Trust does not manage the operating system or applications installed on your VM unless a managed service has been explicitly agreed upon in writing.
8. Acceptable Use
Use of our services is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. Violation of the AUP may result in immediate suspension or termination of your service without refund.
9. Service Levels
Our uptime commitments and remedies for service interruptions are set out in our Service Level Agreement, which is incorporated into these Terms by reference.
10. Suspension and Termination
IT Trust may suspend or terminate your service immediately and without prior notice if:
- You breach these Terms or the Acceptable Use Policy
- Your VM is involved in illegal activity or causing harm to our network or other clients
- We receive a valid legal order requiring suspension or termination
- Continued service poses a security risk to our infrastructure
Where possible, we will attempt to notify you of a suspension via the email address on your account. Termination for cause does not entitle you to a refund.
11. Limitation of Liability
To the maximum extent permitted by South African law, IT Trust's total liability to you for any claims arising from your use of our services shall not exceed the amount you paid to IT Trust in the three months preceding the event giving rise to the claim.
IT Trust shall not be liable for:
- Loss of data, revenue, profits, or business arising from service interruptions
- Any indirect, incidental, special, or consequential damages
- Damage caused by your own actions, including misconfiguration of your VM
- Third-party services, including PayFast payment processing
- Events beyond our reasonable control (force majeure)
12. Intellectual Property
All content, trademarks, and intellectual property on the IT Trust platform remain the property of IT Trust or its licensors. You may not reproduce, distribute, or create derivative works without express written consent.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall first be referred to good-faith negotiation between the parties. If unresolved within 30 days, disputes shall be referred to mediation before any legal proceedings are initiated.
You consent to the jurisdiction of the South African courts for any legal proceedings relating to these Terms.
14. Changes to These Terms
IT Trust reserves the right to update these Terms at any time. Material changes will be communicated via email or through the portal with at least 14 days' notice. Continued use of the service after the effective date constitutes acceptance of the revised Terms.
